Pursuant to Indiana Code § 20-26-7-37 and Indiana Code § 6-1.1-20-3.5, notice is hereby given that the Board of School Trustees of Middlebury Community Schools will meet at 4:00 p.m. on June 7, 2022 and at 4:00 p.m. on June 21, 2022, at the Administration Center, 56853 Northridge Drive, Middlebury, Indiana to hold public hearings. On June 7, 2022, the Board will hold a public hearing to discuss and hear objections and support regarding the proposed renovation of and improvements to Northridge High School, including the construction of a student activity center, and maintenance improvements throughout the School Corporation, including roofing improvements and site improvements (the "Project"). On June 21, 2022, the Board will hold a second public hearing to discuss and hear objections and support regarding the proposed Project and will also consider the adoption of a resolution making a preliminary determination to enter into a lease agreement relating to the Project and to issue bonds to finance the Project. Notice is hereby given to the taxpayers of the school corporation known as Middlebury Community Schools (the "School Corporation") that the Board of School Trustees (the "Board") of the School Corporation will meet at Administration Center, 56853 Northridge Drive, Middlebury, Indiana, at the hour of 4:00 p.m. (Local Time) on March 15, 2022, to consider the following additional appropriation of the bonds (the "Bonds") which the Board has determined to issue. The Board considers such additional appropriation necessary to meet the need existing at this time:

An appropriation in the amount of $7,400,000 from the proceeds of the Bonds, including all original issue premium and all investment earnings thereon, on account of the (i) renovation of and improvements to Orchard View Elementary School, including cafeteria/kitchen renovations; (ii) renovation of and improvements to Middlebury Elementary School, including office renovations and security improvements; (iii) renovation of and improvements to Northridge High School, including the construction of athletics offices; and (iv) purchase of technology hardware and infrastructure (collectively, the "Projects") in the School Corporation, including the incidental expenses necessary to be incurred in connection with the Projects and the issuance of Bonds on account thereof. The funds to meet such additional appropriation are to be provided by the issuance and sale of Bonds by the School Corporation.

The foregoing appropriation is in addition to all appropriations provided for in the existing budget and tax levy, and a need for such appropriation exists by reason of the inadequacy of the present buildings to provide necessary school facilities in the School Corporation.

Taxpayers of the School Corporation appearing at said meeting shall have the right to be heard in respect to the additional appropriation.

NOTICE TO BIDDERS FOR
MIDDLEBURY COMMUNITY SCHOOLS
ELKHART COUNTY, INDIANA

NOTICE IS HEREBY GIVEN, that the Board of School Trustees of the Middlebury Community Schools (the “Owner”) will receive sealed bids for the Northridge High School Additions & Renovations.

Bids will be accepted at the Middlebury Community Schools Administration Office, 56853 Northridge Drive, Middlebury, Indiana, until 10:00 a.m.. (local time), on November 23, 2021. Bids will be opened and tabulated at that time in the Board Room. A Pre-Bid Meeting is scheduled for November 2, 2021 at 10:00 a.m. at the Administration Building.

All bidding and construction shall be in accordance with construction documents prepared by Barton-Coe-Vilamaa, Architect and Engineers, Inc., which can be obtained from the office of Barton-Coe-Vilamaa. Call 260/489-9079 (office of Barton-Coe-Vilamaa) to request an invitation to receive digital access to the bidding documents.

Bidders will be required to file, with their bids, a certified check made payable to the Middlebury Community Schools or a Bid Bond for an amount not less than five percent (5%) of their maximum bid or bids. Should a successful bidder withdraw its bid, or fail to execute a satisfactory Contract, Middlebury Community Schools may then declare the bid deposit or bid bond to be forfeited as liquidated damages.

Each successful bidder shall be required to furnish an approved Performance Bond and a Labor and Materials Payment Bond which cover faithful performance of the contract and the payment of all obligations arising thereunder. A Maintenance Bond shall also be required. Said bonds shall remain in full force and effect for twelve months from the substantial completion of the Work.

The contract will be awarded to the lowest responsive and responsible bidder complying with the conditions for bidding, provided the bid is reasonable and it is to the best interest of the Owner to accept it. The Owner reserves the right to reject the bid of any or all bidder in accordance with Indiana Code 36-1-12.

Bids not reaching said office by 10:00 a.m., on November 23, 2021 will not be opened and will be returned unopened to the original bidder.

Pursuant to action previously taken by the Board of School Trustees (the "Board") of Middlebury Community Schools (the "School Corporation"), a Lease Agreement (the "Lease") between the School Corporation and Middlebury Schools Building Corporation (the "Building Corporation") was executed and entered into on April 16, 2019. The Lease covers the site of the proposed renovation of Northridge High School campus and a portion of Northridge Middle School in Middlebury, Indiana. A copy of the Lease is on file in the Administration Building of the School Corporation, 56853 Northridge Drive, Middlebury, Indiana 46540-9536, and is available for inspection during normal business hours.

Notice of Hearing on Proposed Lease

You are hereby notified that a public hearing will be held before the Board of School Trustees (the "Board") on April 16, 2019 at the hour of 4:00 p.m. (Local Time) at 56853 Northridge Drive, Middlebury, Indiana, upon, a proposed Lease Agreement (the "Lease") to be entered into between Middlebury School Building Corporation (the "Building Corporation"), as lessor, and Middlebury Community Schools (the School Corporation"), as lessee.

The proposed Lease upon which the hearing will be held is for a term of twelve (12) years, commencing with or acquisition of title to the facilities and real estate to be renovated and constructed by the Building Corporation. The Lease provides for rental during renovation in the amount of up to $2,637,500 per payment payable on June 30 and December 31 beginning on June 30, 2020 until completion of construction. Thereafter, the Lease provides for a maximum annual rental of $5,275,000, payable on June 30 and December 31 of each year during the term of the Lease, commencing with the completion of the building or June 30, 2021, whichever is later. As additional rental, the School Corporation shall maintain insurance on the building as required in the Lease, shall pay all taxes and assessments against such property, as well as the cost of alterations and repairs, and shall pay rebate amounts to the United States Treasury, as necessary.

After the sale by the Building Corporation of its ad valorem property tax first mortgage bonds to pay for the cost of construction and renovations, including the acquisition of real estate and other expenses incidental thereto, the annual rental shall be reduced to an amount equal to the multiple of $1,000 next higher than the sum of principal and interest due on such bonds in each twelve-month period ending on January 15 plus $1,500, payable in equal semiannual installments.

The Lease gives an option to the School Corporation to purchase the leased premises on any rental payment date.

The leased premises pursuant to the Lease will be a portion of Northridge Middle School, 56691 Northridge Drive, Middlebury, Indiana 46540 and the real estate upon which the outdoor athletics facilities will be located at Northridge High School, 56779 Northridge Drive, Middlebury, Indiana 46540.

The plans and estimates for the cost of said construction and renovation, as well as a copy of the proposed Lease, are available for inspection by the public on all business days, during business hours, at the Administration Building of the School Corporation, 56853 Northridge Drive, Middlebury, Indiana 46540.

At such hearing all persons interested shall have a right to be heard upon the necessity for the execution of the Lease, and upon whether the Lease rental provided for therein to be paid to the Building Corporation is a fair and reasonable rental for the proposed facilities. Such hearing may be adjourned to a later date or dates, and following such hearing the Board of the School Corporation may either authorize the execution of the Lease as originally agreed upon or may make modifications therein as may be agreed upon with the Building Corporation.

Notice is hereby given to the taxpayers of the Middlebury Community Schools (the "School Corporation") that the Board of School Trustees (the "Board") of the School Corporation will meet at 56853 Northridge Drive, Middlebury, Indiana, at the hour of 4:00 p.m. (Local Time) on April 16, 2019, to consider the following additional appropriation which the Board considers necessary to meet the need existing at this time:

An appropriation in the amount not to exceed $15,000,000, from the proceeds of the Bonds and all investment earnings thereon, on account of the renovation of and improvements to Northridge High School campus, including construction of outdoor athletics facilities and related site improvements, and renovation of and improvements to Northridge Middle School in the School Corporation (the "Project"), including the incidental expenses necessary to be incurred in connection with the Project. The funds to meet such additional appropriation are to be provided by the sale of real estate to the Middlebury Schools Building Corporation.

The foregoing appropriation is in addition to all appropriations provided for in the existing budget and tax levy, and a need for such appropriation exists by reason of the inadequacy of the present buildings to provide necessary school facilities.

Taxpayers of the School Corporation appearing at the meeting shall have the right to be heard in respect to the additional appropriation.

NOTICE OF ADOPTION OF PRELIMINARY DETERMINATION

Notice is hereby given pursuant to Indiana Code § 6-1.1-20-3.1 that the Board of School Trustees (the "Board") of Middlebury Community Schools (the "School Corporation") did, on January 8, 2019, make a preliminary determination to issue bonds and enter into a Lease Agreement (the "Lease") for the renovation of and improvements to Northridge High School campus, including construction of outdoor athletics facilities and related site improvements, and renovation of and improvements to Northridge Middle School (the "Project").

The Lease will be for a maximum term of 12 years with a maximum annual Lease rental of $5,275,000. The maximum annual Lease rental has been estimated based upon an estimated principal amount of bonds of $15,000,000, estimated interest rates ranging from 1.00% to 5.00%, and total estimated interest costs of $1,900,000.

As required by Indiana Code § 6-1.1-20-3.1(b)(1), the following information was available to the public at the public hearings on the preliminary determination: (i) the School Corporation's current and projected annual debt service payments divided by the net assessed value of taxable property within the School Corporation, which is 0.89%; and (ii) the sum of the School Corporation's outstanding long term debt plus the outstanding long term debt of other taxing units that include any other territory of the School Corporation divided by the net assessed value of taxable property within the School Corporation, which is 5.60%.

The School Corporation's current debt service levy is $9,338,215 and the current rate is $0.7499. After the School Corporation enters into the proposed Lease and the bonds are issued, the debt service levy will increase by a maximum of $5,275,000 and the debt service rate will increase by a maximum of $0.3308. However, as existing obligations mature, the anticipated net increase to the debt service fund is expected to be 0.0582 above the current rate.

The estimated amount of the School Corporation's debt service levy and rate that will result during the following 10 years if the School Corporation enters into the lease and issues the bonds, after considering any changes that will occur to the debt service levy and rate during that period on account of any outstanding bonds or lease obligations that will mature or terminate during that period, is as follows:

Pursuant to Indiana Code § 20-26-7-37 and Indiana Code § 6-1.1-20-3.1, notice is hereby given that the Board of School Trustees of the Middlebury Community Schools (the “School Corporation”) will meet at 4:00 p.m. on January 4, 2019 and at 4:00 p.m. on January 8, 2019, at the School Corporation’s Administration Center, 56853 Northridge Drive, Middlebury, Indiana to hold public hearings. On January 4, 2019, the Board will hold a public hearing to discuss and hear objections and support regarding the proposed renovation of and improvements to the Northridge High School campus, including construction of outdoor athletics facilities and related site improvements, and renovation of and improvements to Northridge Middle School (the “Project”).
